Please read these Terms and Conditions carefully before you start to use our Website or our Apps and before purchasing or booking any services through our Website or our Apps. By using our Website or our Apps, you confirm that you accept these Terms and Conditions and that you agree to comply with them regardless of whether you choose to register with us.

All participants must sign the Wøle´ Yøga Health & Safety Waiver on their Momence Account prior to attending an in-studio or online class. It is the responsibility of the client to ensure they have understood and signed the waiver and are in a good state of health before participating in a class or event.Wøle´ Yøga Retreat 

Please read these Terms and Conditions carefully before booking your retreat.

Your Contract is with our third party retreat partners, full details are provided on your invoice.

1: BOOKING PROCEDURE

(a) On making a booking with us, each person travelling must accept the terms of these Booking Terms and Conditions.

Your deposit is:

• A non-refundable, non-transferrable 50% deposit is required to secure the booking.
• The balance, also non-refundable and non-transferrable is due 8 weeks before the start of the retreat.
• You can also pay 100% of the room cost to confirm your spot.

(b) Where a deposit has been paid, a final request will be sent to you 9 weeks before your departure date and payment of the balance of the price of the retreat will become due 8 weeks prior to your departure date. If the balance of the price of your retreat is not paid 8 weeks prior to your departure date, we reserve the right to cancel your place, retain your payments and apply the Cancellation Charges set out in Section 4.

(c) For bookings made within 8 weeks of the date of departure, the full payment will become due immediately upon confirmation of the booking. Once payment has been made any subsequent cancellation will incur Cancellation Charges as set out in section 4.

(d) Your booking is considered definite, and a contract will exist between you and Wøle´ Yøga only when an email of confirmation has been sent to you. No contract will exist between us prior to our issuing the confirmation email.

2: CANCELLATION OR POSTPONEMENT BY US

(a) Wøle´ Yøga reserves the right in any circumstances to cancel your retreat at any time before the start date, in which case we will offer a refund in full of all monies paid for your retreat. You would also be able to transfer your payment to another retreat.

(b) Wøle´ Yøga reserves the right in any circumstances to postpone and reschedule your retreat at any time up to 8 weeks before the start date, in which case we will offer to transfer your payment to the new dates or to another retreat. Any other retreat payments will be refunded.

(C) Compensation will not be paid if Wøle´ Yøga is forced to cancel or in any way change your retreat due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, pandemic, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure.

Wøle´ Yøga will not be responsible for any monies you have paid for travel, so please make sure you have booked flexible flights with an airline that will allow free date changes or that issues credit vouchers for future flights.

3: INSURANCE

Travel insurance is mandatory for all of our retreats and you will be asked to produce details 8 weeks before the retreat. If you do not produce the necessary information your place may be cancelled and no refund given.

You are responsible for arranging full travel insurance which should cover you for the activities you plan to undertake and have adequate cover for travel delay, cancellation and curtailment, medical expenses and your personal belongings. We recommend you take out travel insurance within 15 days of booking your retreat.

4: CANCELLATION BY YOU

You may cancel your retreat at any time providing that the cancellation is made by the person who submitted the booking form and it is communicated to us in writing. Cancellation will take effect the day such notification is received by us.

When you cancel your retreat place, we will retain your deposit in all circumstances. We will apply cancellation charges as shown below.

Depending on the Number of Weeks Before Departure, Cancellation Charges are:

• 8 weeks or more: Deposit only
• 4-8 weeks: 75% of retreat cost
• Less than 4 weeks: 100% of retreat cost

If you are no longer able to attend your retreat, we may be able to move your booking to another retreat if we are able to re-sell your place. This is only possible if you let us know at least 8 weeks before the retreat and it is dependent on if we can re-sell your place. Otherwise our normal cancellation charges apply.

Once your holiday has commenced, no refund or part refund or unused portion of the retreat will be repaid in the event of cancellation by you. If the reason for cancellation is covered under the terms of an Insurance Policy, you may be able to reclaim these charges.

5: ACKNOWLEDGMENT OF RISKS AND INDEMNITY

You warrant that you are aware that all exercise and travel carries risks, and acknowledge you are participating willingly, and in knowledge of these risks.

You recognise that we are not able to provide you with medical advice, and that any information provided should be used as a guideline only. If you have any prior knowledge of health concerns or health risks, you acknowledge that it is your responsibility to seek clearance from a health care professional prior to attending any of our retreats.

You agree to fully indemnify without limitation any teacher(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Wøle´ Yøga.

6: YOUR HEALTH, ADVANCE GUEST INFORMATION AND WAIVER

It is your responsibility to let us know if you have any mental or physical health conditions and dietary requirements that may impact your participation in a retreat before you book.

If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right, for your own wellbeing, to advise you not to book a particular retreat.

It is your responsibility to consult a doctor with an understanding of yoga and fitness to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may choose to do whilst on the retreat.

7: FOOD ALLERGIES AND DIETARY REQUESTS

If you have any food allergies or dietary requests you must contact us in writing before you complete your booking to be sure we can meet your needs.

If you have not received written confirmation from us that we can meet your dietary requests and you are unable to consume the menu offered, we will not be able to offer alternatives. If you choose to not attend or continue your retreat in this circumstance, no refund will be given and/or any costs for early departure must be met by the guest.

8: GROUP CONDUCT

Guests who are deemed by our retreat host to be acting in a way that is inappropriate towards our retreat teams, our hosts or other guests will be requested to stop. If the inappropriate conduct continues our retreat host may ask the guest to leave the retreat.

Inappropriate conduct includes verbal abuse, aggressive behaviour and violence, repeatedly disruptive behaviour, consuming excessive alcohol or drugs, sexual harassment, including sexual comments and unwanted touching. It also includes unwelcome behaviour that intimidates, offends or humiliates a person because of a particular personal characteristic such as age, race, gender, disability, religion or sexuality. It also includes culturally disrespectful or insensitive behaviour.

No refund will be given in this circumstance and all costs for early departure must be met by the guest.

We kindly ask guests to treat the retreat property with care and respect just as you would your own homes. We also recognise that accidents can occur despite best intentions, and we kindly request that any deliberate or negligent damage caused to the property be reported promptly. In such cases, additional charges may apply to cover the necessary repairs or replacements.

9: ACTIVITIES

Guests are expected to follow the retreat plan and only partake in the activities offered within this plan. Guest who wish to undertake additional/alternative activities not offered on their retreat should book extra days before or after the retreat so they can enjoy these in their own time.

10: SURCHARGES

We reserve the right to increase the price of your transfer arrangements and excursions to allow for variations in transportation costs due, taxis or fees chargeable for services and the exchange rate applicable to your travel arrangements.

11: RETREAT PRICES

Our retreat prices include accommodation, all meals as advertised and all group yoga classes and any listed excursions, unless stated differently in your booking confirmation email.

Our prices exclude flights, travel insurance, tips, optional excursions, transfers from airports and train stations unless otherwise stated.

12: FLIGHTS

We do not book flights for our guests. We may recommend suitable flights, trains and provide directions but Wøle´ Yøga is not responsible for your travel plans and arrangements. It is your responsibility to confirm your flight times and check in with your airline before your outward and return journey.

13: OUR LIABILITY TO YOU

(a) We accept responsibility for ensuring that the retreats that you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard. We accept responsibility for the acts and/or omissions of our employees, agents and suppliers except where they lead to death, injury or illness (see below).

(b) We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, together with our suppliers and sub-contractors, servants and/or agents of the same whilst acting within the scope of, or in the course of their employment in the provision of your retreat. We will, accordingly, pay to our client such damages as might have been awarded in such circumstances under English law.

14: PASSPORTS, VISAS AND OTHER HEALTH REQUIREMENTS

You are responsible for ensuring that you have a valid passport, any necessary visas and any necessary or required vaccines or other health requirements for your trip.

15: COMPLAINTS

If you have a problem during your retreat, please inform a member of our team immediately, who will endeavour to put things right. If your complaint cannot be resolved locally, you must advise us in writing immediately on your return.

16: THE CONTRACT

This contract is made on the terms of these Booking Conditions, which are governed by English and Welsh law and the exclusive jurisdiction of the English and Welsh Courts.

Online Services Terms of Use

Account creation
You warrant that:

• The Personal Data which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and
• You will notify us immediately of any changes to the Personal Data by updating these details on your online account.
• You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.

Pricing
Information displayed on the website related to pricing and service availability is subject to change by Wøle´ Yøga without notice.

Online bookings

• Pre-booked classes must be paid for in advance.
• We encourage you to sign into online classes a minimum of 15 minutes prior to the class start time.

Payment 

• If the booking is paid by debit or credit card, you authorize Wøle´ Yøga 

to debit the card provided by you without notice to you. Authorized debits include, but are not limited to, all late canceled or missed classes fines under the monthly unlimited + monthly 5 pack memberships.

• We are cashless in all our centres and events to make the check-in process quicker and easier for clients. When paying you can use any major credit or debit card. You can also save your card to your account and pay online for greater convenience.

Monthly Memberships

• Monthly Unlimited + Monthly 5 Pass are both rolling monthly contracts and can be canceled with 1 calendar month's notice.
• Activates upon the date of first visit and auto renews on that date thereafter.
• Pass valid for use by named pass holder only.
• Not eligible for refund or transfer.
• Ablavi monthly passes can be placed on hold for up to 4 weeks twice (minimum hold period 2 weeks). Clients may hold for a maximum of 8 weeks in any 1 calendar year.
• Akueba monthly passes can be placed on hold for up to 4 weeks (minimum hold period 2 weeks). Clients may hold for a maximum of 4 weeks in any 1 calendar year.
• Holds must be requested by emailing info@woleyoga.com, and 48 hours’ notice must be given prior to the hold start date. Holds cannot be backdated and must be in weekly increments (e.g. 2 or 3 weeks, not 17 days).
• Holds requested for medical reasons may exceed 60 days if accompanied by a doctor’s note.

Class Pack Expiries

• 10 Classes: Ablavi passes have 3 month expiry and Akuavi + Akueba have 2 months from date of first visit.
• 5 Classes: Akueba passes have a 2 month expiry and Akuavi have 1 month from the date of first visit.
• 2 for £25: 2 week expiry from date of first visit.
• Drop-in: 1 month expiry from date of first visit.

Cancellation policies

Classes

• If are booked into a class but can no longer attend, you must cancel the class. To cancel you must do this through your Momence profile.
• Wøle´ Yøga’s class cancellation policy is 9 hours. If you do not cancel with at least 9 hours prior notice, this will constitute a late cancellation and your credit will not be returned to your account. If you have a monthly membership you will be charged £5.
• If you ‘Early cancel’ (up to 9 hours before class) the class credit will automatically be returned to your account.
• If a class is fully booked, you can join the waitlist and you will be automatically enrolled if anyone cancels. The waitlist closes 1 hour before the class starts.
• If your class is canceled by Wøle´ Yøga your credit will be returned to your account.
• ClassPass or other external third-party bookings are liable to their cancellation policy. We cannot override this.
• If you are more than 5 minutes late you will not be admitted, no exceptions, and this will be treated as a late cancellation.
• Please always check in at the front desk before your class, if you are a no-show we will charge you as a late cancellation.

Treatments

• We operate a 24 hour cancellation policy on behalf of the therapists. For cancellations made with less than 24 hours notice or if you do not turn up for your appointment, you will be charged the full appointment fee in these circumstances.
• The details shown on the Wøle´ Yøga email booking confirmation + appointment reminder is the date and time for which you will be charged if you miss your appointment or cancel less than 24 hours prior to the booked appointment.

Workshops & Courses

• Less than 24 hours notice: No credit or refund will be given.
• More than 24 hours (up to 7 days) notice: 75% refund or 100% credit.
• More than 7 days notice: Full refund or studio credit.
• If a course or workshop is canceled you will be offered either a cash refund or the option of being transferred to an alternative event. Once you have committed to a course or workshop, we recommend that you attend the scheduled number of sessions to get the most out of the programme.
• We are unable to give refunds in the case of canceled transport (trains, airplanes etc). Please ensure you take out relevant insurance to protect yourself against this.
• Refunds are not possible to be made retrospectively. If we have not heard from you by 24 hours following the end of a workshop we will not be able to process any refunds.
• If your workshop is canceled by Wøle´ Yøga, we will notify you as soon as we have knowledge of the cancellation and will refund you the full £ (sterling) amount you have paid us in respect of the workshop. We will not be responsible for any additional expenses which you may have incurred in respect of the workshop, including travel, accommodation or exchange rate losses.

Retail

• Retail items purchased at the studio, or online, can be exchanged if returned within 30 days of purchase. Items must be unused and undamaged.
• Credit on account at Wøle´ Yøga or exchange will be provided if an item is found faulty or in unusable condition.

Promotions & discounts

• Corporate discounts can be provided on request.
• Promotions cannot be combined or backdated.

Gift cards

• Please protect your Gift Card and treat it as cash; we cannot replace lost, stolen or damaged cards.
• The gift card will expire 12 months from purchase. We will not refund any balance remaining and we will invalidate the card.
• Gift cards cannot be exchanged for cash. We do not give change or refunds on gift cards or e-gift cards.
• If you are using a Gift Card online and the total order value is less than the value of the card, any balance will remain on the card and may be applied to future purchases, provided that the card has not expired. However a Gift Card cannot be used for partial payment online.
• We reserve the right to refuse to accept a gift card which we deem to be tampered with, duplicated or which otherwise is suspected to be affected by fraud.
• We reserve the right to amend the gift card and e-gift card terms and conditions from time to time, where we consider it reasonable and necessary to do so.

Privates/PT

• Less than 7 days notice: No credit or refund will be given.
• More than 7 days notice: Full refund or studio credit.
• If your private class is canceled by Wøle´ Yøga, we will notify you as soon as we have knowledge of the cancellation and will refund you the full £ (sterling) amount you have paid us in respect of the private class. We will not be responsible for any additional expenses which you may have incurred in respect of the private class, including travel, accommodation or exchange rate losses.

Intellectual property and right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

You grant to us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use (including but not limited to publishing, exploiting and modifying) any material you email, post or submit to us. For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Our rights

We reserve the right to:

• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
• change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change.

It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether expressed or implied in relation to its accuracy. The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

• any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
• any loss of goodwill or reputation; or
• any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Donations Terms & Conditions:

Terms and conditions

Unless otherwise agreed in writing, acceptance and acknowledgment of your donation to Wøle´Yøga. By participating in the appeal you are deemed to have read, understood and agreed to these terms:

1. You are free to donate any amount to the appeal but if you donated £25 or more, we would love to acknowledge your support by displaying a message from you in our gallery.
2. Names of individuals, trusts and foundations will be accepted for display. Acknowledgements are limited to 30 characters including spaces, punctuation and text.
3. All acknowledgements are subject to approval by the our social media team at their absolute discretion, and we reserve the right not to display or to remove any acknowledgement at any time.
4. Wøle´Yøga has sole discretion over the location and display of the names on the Gallery materials and reserves the right to relocate or remove the acknowledgement at any time and for any reason.
5. Wøle´Yøga intends that the acknowledgements will be displayed in the Gallery. 
6. The Gallery intends that the names will be on temporary basis.
7. In addition to any data processing undertaken we will collect and use your personal data for the administration of any acknowledgement given and to provide you with updates on our progress.
8. Donations are voluntary and no refunds can be offered in any circumstances unless the donation is rejected by the Wøle´Yøga. 

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
